Flake could have easily voted not to move Kavanaugh's nomination forward. His vote would have tipped the scales at that point. Instead, he threatened to vote no if there is no FBI investigation.
Ted Cruz stated he was voting not to move Kavanaugh forward. His vote was not conditional. His vote would have prevented Kavanaugh from moving forward if the Senate Judicial Committee chairman decided not to ask for the investigation.
